- Dispositive claims - an economic right
- A person/entity who has acquired the right to use the patent, the patent
application or the invention

### The Act on the Right to Employee's Inventions
- Applicable area: inventions patentable in Sweden made by employees (§1)
- Is not applicable for teachers/researchers at universities (§1);
"the teacher's exemptions"

### Patent Application Requirements

The first step to making a new patent is to ask yourself if the thing you want
to patent is a discovery or an invention.

- Discovery = Observation, "finding"
- Invention = Constructive creation of something new

E.g.:

- The electric motor was an invention resulting from the discovery of the
electromagnetic field.
- Gene sequences found in the human body are discoveries but if they can be
isolated they may be patentable, even if the structure is identical to the
human body gene sequence...

### Three types of patents

- Product
- Method/process
- Application/use

The three patent types are deduced from a comparison of the right to exlude
others when holding a patent, PA §3 p.1-3

### Not Patentable Inventions in Themsolves (in Sweden)

- Sicentific theories §1p. 1 PA
- Mathematical methods §1p. 1 PA
- Artistic works §1p. 2 PA
- Software ('computer program') §1p. 3 PA
- Business methods §1p.3 PA
