1. General Terms
Pundit Code is divided into Pundit Server Code and Pundit Client code.

Pundit Server
Pundit Server is released under a dual license model.

1) The latest version of the Pundit Server is released under a commercial
licence (“Pundit Server Embargo License”). 

2) Pundit Server previous versions are released under a AGPL 3.0 
(http://www.gnu.org/licenses/agpl-3.0.html). Contributors are asked to sign 
the Pundit Committer’s Agreement v1.0 (see §2).

Independently of the release cycle, a proprietary embargoed version 
(“latest version”) becomes a “previous version” after 6 months of its 
publication. Hence all new versions of the Pundit Server will be released 
under a AGPL 3.0 license after 6 months of embargo. 
 
Pundit Client
Pundit Client is released under a AGPL 3.0 license 
(http://www.gnu.org/licenses/agpl-3.0.html). Contributors are asked to 
sign the Pundit Committer’s Agreement v1.0 (see §2).

2. Pundit Committer’s Agreement v1.0

In order to become a Committer - that is, to obtain the ability to contribute
information (“Code”) to Pundit server and client source code or data 
repository - you (“You”) must indicate your agreement to the terms below 
by completing and signing this agreement and returning it to a Net7 at the 
address pundit@netseven.it.

2. Treatment of Account
You will receive one or more sets of Pundit repository access credentials. 
You will not allow anyone else to use these credentials to access the system. 
Should You become aware of any such use, You will immediately notify Net7 at 
pundit@netseven.it; until such notice is received You will be presumed to 
have taken all actions made using Your credentials. Net7 will have complete 
control and discretion over capabilities associated with Your credentials and 
may change them for any reason at any time. Your name and email address, or a 
derivative of it, may be visible worldwide via the Internet.

3. License Terms
Code committed to the Pundit repository must be governed by the AGPL 3.0 
licence. You will verify that committed Code contains appropriate boilerplate 
licensing text.

4. Committing Code Created by Others
You may check in Code to the Pundit repository that was not written by 
You, provided that:

a) The checkin comment contains information (or references to information) 
sufficient to identify the author of the Code, including at minimum an 
email address; and
b) You make all reasonable and appropriate efforts to ensure that such 
Code conforms to the terms of this agreement.

5. Notices and Knowledge
By contributing Code, You confirm that, to the best of Your knowledge:
a) For any Code contributed under AGPL 3.0 
(http://www.gnu.org/licenses/agpl-3.0.html) have been appropriately placed; and
b) Code does not violate the rights of any person or entity.

If You contribute Code on behalf of Your employer, then You must confirm 
that an appropriate representative of that employer has authorized the 
inclusion of such Code in a Net7 repository under the terms of this agreement.

3. Licenza d’uso del Software Pundit Server, ultima versione (“Pundit Server Embargo License”)
 
Premessa
La presente licenza d’uso, destinata agli utenti del software Pundit Server, è un accordo che definisce l’uso del software e stabilisce i termini e le condizioni unicamente per la licenza d’uso del medesimo e per gli eventuali moduli ad esso collegati acquistati anche successivamente all’acquisto del Software.
Il Software è distribuito e commercializzato a soggetti diversi dai c.d. “Consumatori” secondo la definizione di cui al d.lgs 6.9.05 n. 206 (Codice del Consumo), deve, pertanto, escludersi l’applicabilità alla presente licenza della disciplina contenuta nel detto Codice del Consumo.
Il Software Pundit Server è protetto da leggi sul copyright, sul diritto d’autore e dalle leggi sulla tutela del software, oltre che dai trattati internazionali sul copyright.
Il Software Pundit Server è di proprietà intellettuale di Net7, la licenza d'uso pertanto non attribuisce al cliente alcun diritto sul programma sorgente, e tutte le tecniche, gli algoritmi e i procedimenti contenuti nel programma e nella relativa documentazione sono informazioni riservate di proprietà dell'azienda, e non possono essere utilizzati dal cliente per scopi diversi da quelli indicati nella presente licenza.
Il Software non viene né venduto né regalato, ma solo concesso in licenza d’uso, in stretta correlazione con il presente documento.
Qualora non doveste acconsentire ai termini della presente licenza, non vi sarà consentito di utilizzare il Software.
 
1. Concessione della licenza
Con il presente accordo Net7 concede al Cliente in licenza d'uso a tempo indeterminato, non esclusivo, e non trasferibile, il software Pundit Server qui di seguito indicato «Software», con i seguenti limiti:
- l’utente può installare ed utilizzare un’unica copia del Software su di un unico computer o su più computer nell’ambito di un sistema client-server sino ad un numero massimo di computer indicato al momento dell’acquisto. Non potrà copiare in nessun modo (neanche parzialmente) e per nessuna ragione il Software, salvo la facoltà eseguire una sola copia di backup o di archivio del Software a scopo di riserva. La presente licenza non può essere condivisa od utilizzata contemporaneamente su diversi computer, salvo che siano nell’ambito di un sistema client-server. E’ facoltà di Net7 attivare dispositivi che limitino o impediscano la duplicazione del Software o la sua installazione non autorizzata.
La copia di riserva dovrà riportare (in caratteri perfettamente leggibili) tutte le indicazioni relative alla riservatezza, alla proprietà, al diritto d’autore e ai marchi impressi sul Software originale. Sia la copia originale del Software sia quella di archivio sono soggette alle restrizioni previste nel presente accordo e devono entrambe essere restituite in caso di cessazione a qualsiasi titolo intervenute della presente licenza.
- l’utente non può in alcun modo invertire l’automatismo, decompilare o disassemblare il Software, né tentare in alcun modo di ottenere il codice sorgente.
Il Software Pundit Server è concesso in licenza come prodotto unico, i suoi componenti non possono pertanto essere separati al fine di essere utilizzati su più computer né essere utilizzati separatamente in altro modo.
- è fatto espresso divieto all’utente di cedere il Software o darlo in sublicenza a terzi o comunque di consentirne l'uso da parte di terzi sia a titolo gratuito che a titolo oneroso.
 
2. Durata e clausola risolutiva espressa
La licenza si considera a tempo indeterminato.
Tuttavia, qualora l’utente dovesse violare uno qualsiasi dei limiti e divieti stabiliti agli artt. 1) e 3) della presente licenza, la stessa si intenderà risolta di diritto e con effetto immediato senza necessità di preavviso ex art. 1456 c.c.
Sarà quindi obbligo dell’utente restituire il Software Pundit Server ad Net7, entro e non oltre tre giorni dalla comunicazione dell’avvenuta risoluzione fermo restando il diritto di Net7 ad ottenere il risarcimento del danno sofferto a causa dell’inadempimento dell’utente.
 
3. Diritti d’autore, di proprietà industriale e tutela marchio
Ai sensi e per gli effetti della presente licenza, per “Diritti” si intendono i diritti di brevetto, i diritti di autore, i diritti sui marchi (registrati e non), i diritti sui modelli d’utilità e gli altri diritti di proprietà intellettuale previsti in un qualsiasi ordinamento nazionale.
Tutti i  titoli, le didascalie i testi le immagini relativi al Software (includendo con ciò, ma non limitando, fotografie, immagini, disegni, animazioni, video, audio, musica, applets, script) i materiali di accompagnamento stampati e quant’altro costituisce il prodotto Pundit Server sono di proprietà intellettuale dell’Net7. L’utente dovrà pertanto utilizzare il Software come ogni altro materiale coperto da diritto d’autore non essendogli riconosciuto alcun diritto di utilizzo di  quanto in esso contenuto.
L’utente garantisce che nessun diritto verrà violato o comunque pregiudicato nel corso dell’utilizzo del Software rimanendo, Net7, l’esclusiva titolare dei diritti correlati al Software.
Ogni abuso, uso illecito, illegale, immorale improprio o comunque non conforme a quanto stabilito dalla presente licenza, operato dall’utente o dai collaboratori  del medesimo, costituisce violazione del diritto di proprietà dell’Net7 e potrà pertanto essere perseguito con gli strumenti di legge.
 
4. Responsabilità e garanzie
è responsabilità dell’utente verificare la compatibilità del Software con il proprio sistema operativo e con gli altri requisiti di sistema dei computer su cui intende istallare ed utilizzare il Software e verificare la sua idoneità all’utilizzo che intende farne prima di procedere all’acquisto del diritto d’uso.
Net7 si fa esclusivamente garante del diritto di concedere il Software Pundit Server in licenza d’uso all’utente, fornendo al medesimo il Software nello stato in cui si trova, escludendo esplicitamente qualsiasi responsabilità per l’uso che ne verrà fatto se diverso da quello stabilito nella presente licenza, nonché qualsiasi responsabilità per danni diretti o indiretti materiali o morale che ne dovessero derivare a seguito dell’istallazione e/o utilizzo.
In particolare sono escluse esplicitamente responsabilità di Net7 per eventuali danni diretti od indiretti, software e/o hardware, che dovessero derivare a seguito della sua istallazione e/o utilizzo, siano dovuti o meno a difetti nel software e/o eventuale imperizia nell’istallazione e/o utilizzo.
Net7 non sarà in nessun caso responsabile nei confronti dell’utente del Software per eventuali perdite di dati, perdita di profitto, perdita di produttività, spese generali, mancati ammortamenti, mancato guadagno, né per qualsiasi altra forma di lucro cessante o danno indiretto e consequenziale connesso all’esecuzione, applicazione, interpretazione del presente contratto, degli impegni delle parti ai sensi dello stesso e dell’esercizio delle facoltà, dei diritti e delle riserve attribuite alle parti ai sensi della seguente licenza.
Anche in caso di vizi Net7 è tenuta soltanto alla sostituzione del Software, con esclusione di qualsiasi altro obbligo o responsabilità.
Net7 garantisce esclusivamente che il software è in grado di eseguire le operazioni previste e descritte nella relativa documentazione tecnica. Qualsiasi eventuale verifica sarà effettuata utilizzando esclusivamente i test predisposti dalla locatrice.
La garanzia è peraltro condizionata al corretto funzionamento dell'elaboratore e del software di sistema e al corretto uso del sistema da parte del Cliente che deve istallare ed utilizzare il Software esclusivamente secondo le indicazioni tecniche fornite da Net7.
 
5. Leggi applicabili
La presente licenza è regolata dalle leggi italiane vigenti, anche per quanto riguarda il brevetto e il copyright.
 
6. Controversie
In caso di controversie nate in relazione al presente contratto sarà competente il Foro di Pisa.
