Stanford University (“Stanford”) wishes to make data available for research and educational purposes to qualified requestors on a non-exclusive basis, but only if the data are used and protected in accordance with the terms and conditions stated in this License and the EHRSHOT Data Set Rules of Behavior 1.0 (See Addendum).
It is hereby agreed between the data requestor, hereinafter referred to as the "LICENSEE", and STANFORD, that:
- The LICENSEE will not attempt to identify any individual or institution referenced in the EHRSHOT Data Set.
- The LICENSEE will exercise all reasonable and prudent care to avoid disclosure of the identity of any individual or institution referenced in the EHRSHOT Data Set in any publication or other communication.
- The LICENSEE will not share access to EHRSHOT Data Set restricted data with anyone else.
- The LICENSEE will exercise all reasonable and prudent care to maintain the physical and electronic security of EHRSHOT DATA SET restricted data.
- All individually identifiable health information has been removed from data. Data does not include “Protected Health Information” (“PHI”) as defined in 45 C.F.R. Section 160.103. If the LICENSEE finds information within EHRSHOT DATA SET restricted data that he or she believes might permit identification of any individual or institution, the LICENSEE will report the location of this information promptly by email to [email protected], citing the location of the specific information in question.
- The LICENSEE will use the data for the sole purpose of lawful use in scientific research and no other.
- The LICENSEE will be responsible for ensuring that he or she maintains up to date certification in human research subject protection and HIPAA regulations.
- The LICENSEE agrees to contribute code associated with publications arising from this data to a repository that is open to the research community.
- The LICENSEE acknowledges that the EHRSHOT Data Set has not been reviewed or approved by the Food and Drug Administration, and is for non-clinical, research and education use only. In no event shall data or images generated through the use of the EHRSHOT Data Set be used or relied upon in the diagnosis or provision of patient care.
- This agreement may be terminated by either party at any time, but the LICENSEE's obligations with respect to EHRSHOT Data Set shall continue after termination.
- The term of this agreement will be 3 years from the day an account is created to access the data.
THE DATA ARE PROVIDED "AS IS" AND STANFORD UNIVERSITY AND ITS COLLABORATORS, DO NOT MAKE WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE DATA OR THE USE OR OTHER DEALINGS IN THE DATA. LICENSEE may use EHRSHOT Data Set for legal purposes only.
LICENSEE agrees to indemnify and hold Stanford harmless from any claims, losses or damages, including legal fees, arising out of or resulting from your use of the EHRSHOT Data Set or your violation or role in violation of these Terms. You agree to fully cooperate in Stanford’s defense against any such claims. These Terms shall be governed by and interpreted in accordance with the laws of California.
If granted access, I commit to the following:

I will not attempt to identify any individual or institution referenced in the EHRSHOT Data Set

I will not attempt to identity any individual or institution referenced in EHRSHOT DatSet restricted data in any publication or other communication.

I will not share access to the EHRSHOT Data Set with anyone else.

I will exercise all reasonable and prudent care to maintain the physical and electronic security of the EHRSHOT Data Set.

I have requested access to the EHRSHOT Data Set for the sole purpose of lawful use in scientific research, and I will use my privilege of access, if it is granted, for this purpose and no other.

I have completed a CITI training program in human research subject protections and HIPAA regulations, and I am submitting proof of having done so.

I will indicate the general purpose for which I intend to use the database in my application.

If I develop other models, data sets, or other services or products derived from the EHRSHOT Data Set, then I will apply the same licensing terms and ethical standards as those that apply to the EHRSHOT Data Set.

This agreement may be terminated by either party at any time, but my obligations with respect to the EHRSHOT Data Set shall continue after termination.

My use of the EHRSHOT Data Set will at all times comply with state, local, national and international laws including but not limited to the HIPAA Privacy Rule 45 CFR 160 and 164 (as amended), GDPR and applicable privacy and data security regulations as may apply to such use.
